Acknowledgment of Risks
I, the undersigned, understand and acknowledge that participation in play, physical activities, and use of equipment or facilities at Active Adventures Indoor Play Space (“Active Adventures”) involves inherent and unavoidable risks. This acknowledgement is made on behalf of myself, my child(ren), and any guests I may bring. We recognize that these risks may include but not limited to: slips, trips, falls, collisions, contact with equipment or other participants, and other incidents that may result in minor or serious injury, illness, or death, and we accept responsibility for our participation.
User Responsibility
I, the undersigned, understand that:
- Active Adventures is an unstaffed facility, and I am solely responsible for supervising myself, child(ren), and any guests I may bring, at all times.
- I am responsible for ensuring that myself, child(ren), and any guests I may bring, comply with all posted rules, including but not limited to all “Active Adventures Rules” and all “Active Adventures Area Rules” displayed in each play zone, activity room, and common areas.
- I will ensure all myself, child(ren), and any guests I may bring, play safely, respect others, and use the equipment only as intended.
- I understand that failure to follow any posted rule, guideline, or staff instruction may result in removal from the facility without refund.
- I acknowledge and agree that if myself, child(ren), and any guests I may bring, fail to follow the expectations of Active Adventures, we may not be permitted to return in the future.
Release of Liability and Indemnification
In consideration of being permitted to enter and use the facilities at Active Adventures, I, on behalf of myself, child(ren), and any guests I may bring, voluntarily assume all risks associated with participation and use of the facility.
I, on behalf of myself, child(ren), and any guests I may bring, hereby waive, release, and forever discharge Active Adventures, its owners, employees, contractors, and agents from any and all claims, demands, losses, damages, liabilities, costs, or causes of action of any kind, including those arising from the negligence of Active Adventures or its representatives.
I on behalf of myself, child(ren), and any guests I may bring further agree to indemnify and hold harmless Active Adventures and its representatives from any claim or liability (including legal fees) brought by or on by myself, child(ren), and any guests I may bring, arising from participation or use of the facility.
Medical Declaration and Consent
I certify myself, child(ren), and any guests I may bring, are physically fit to participate and have no known medical conditions that would make such activities unsafe. In the event of an emergency, I authorize medical treatment for myself, child(ren), and any guests I may bring, and agree to assume and reimburse all costs related to such treatment.
Photo/Video Release
I on behalf of myself, child(ren), and any guests I may bring, grant permission to Active Adventures to capture photographs and videos of myself, child(ren), and any guests I may bring, during my participation in activities at the facility. I on behalf of myself, child(ren), and any guests I may bring, understand that these images and videos may be used for promotional purposes, including but not limited to social media, website content, marketing materials, and other promotional avenues which is voluntary participation.
Acknowledgment and Signature
I, on behalf of myself, child(ren), and any guests I may bring, have read and understood this Waiver and Release of Liability. I understand that it affects my legal rights and agree to be bound by its terms. I am signing it voluntarily and acknowledge it shall apply to all future visits and activities at Active Adventures.
Facility Rules Summary
By signing, I confirm that I have read, understood, and agree to abide by all General Facility Rules, including but not limited to:
- No shoes beyond the entrance (socks required).
- No food or drink outside the café or designated areas.
- Respect others and use equipment safely.
- Follow all posted Active Adventures rules in every area of the facility.
- Adult supervision required at all times.
- Play safely. Use all equipment as intended and stay within age-appropriate areas.
- Play in age-appropriate areas only.
- Please clean up after yourself and your child(ren) and guests.
- Report unsafe conditions or behavior to 763-333-6502 or fun@activeadventures.org
- Keep belongings in designated areas. Active Adventures is not responsible for lost or stolen items.
- Hours of operation: 8am – 8pm unless private event.
- No animals allowed in facility except for certified service animals.
- Stay healthy — please do not enter if you or your child are feeling unwell.
